Condiciones del Servicio
1 Objeto y aceptación
Estas Condiciones del Servicio (en adelante, «las Condiciones») regulan la relación entre SmartCo Iniciativas Tecnológicas, S.L. («SmartCo») y las personas que utilizan la aplicación y el servicio Adtropia («Adtropia» o «el servicio»). Al registrarse y utilizar Adtropia, usted acepta estas Condiciones; si no está de acuerdo con ellas, no utilice el servicio.
Estas Condiciones se complementan con el Aviso Legal y la Política de Privacidad del sitio, que forman parte del marco de uso de Adtropia.
2 Acceso y edad mínima
Para crear una cuenta y utilizar Adtropia es necesario ser mayor de 18 años. Adtropia es un servicio dirigido a personas adultas y no está destinado a menores de edad.
El acceso se realiza mediante autenticación con un proveedor externo (Google o Apple). Usted es responsable de la veracidad de los datos con los que accede.
3 Su cuenta
Cada cuenta es personal. Usted es responsable de la actividad realizada desde su cuenta y de mantener la confidencialidad del acceso a los proveedores de identidad que utilice.
El catálogo de anuncios que crea en Adtropia está asociado a su cuenta y es de uso personal.
4 Uso aceptable del servicio
Usted se compromete a utilizar Adtropia de forma lícita y conforme a estas Condiciones. En particular, se compromete a no:
- Utilizar el servicio con fines ilícitos o que vulneren derechos de terceros.
- Intentar acceder a cuentas, datos o áreas del servicio que no le correspondan.
- Interferir en el funcionamiento del servicio, introducir código malicioso o realizar extracciones automatizadas de datos.
- Suplantar la identidad de otras personas o entidades.
Si detectamos un uso que pueda contravenir estas Condiciones, se lo comunicaremos y le pediremos que lo corrija, indicándole cómo hacerlo.
Si el incumplimiento es grave o persiste tras nuestro aviso, SmartCo podrá suspender o cancelar su cuenta y desactivar los enlaces compartidos afectados, informándole del motivo. Cuando el uso sea ilícito o ponga en riesgo el servicio, a otros usuarios o a terceros, podremos adoptar estas medidas sin aviso previo, comunicándoselo después.
5 Su contenido y su catálogo
SmartCo no reclama la propiedad de los anuncios que usted captura y guarda («su contenido»), ni de las etiquetas y correcciones que añada.
Para prestarle el servicio, usted concede a SmartCo una licencia limitada, no exclusiva y gratuita para almacenar, procesar y analizar su contenido en la medida necesaria para construir y mantener su catálogo personal y las funciones asociadas (como la organización automática mediante inteligencia artificial), así como para elaborar la información estadística agregada y anonimizada descrita en la Política de Privacidad. Esta licencia sobre el contenido no sustituye ni modifica las bases jurídicas aplicables al tratamiento de datos personales, que se describen en la Política de Privacidad. La licencia sobre su contenido termina cuando usted elimina ese contenido o su cuenta; las estadísticas que ya hayan sido anonimizadas de forma efectiva podrán conservarse en los términos indicados en la Política de Privacidad.
Usted es responsable del contenido que captura. Los anuncios pueden contener marcas, imágenes y creatividades cuya titularidad corresponde a sus respectivos anunciantes; Adtropia le permite organizar, para su uso personal, contenido que usted ya ha encontrado, y no distribuye por su cuenta creatividades publicitarias de terceros. Cuando usted comparte un anuncio de su catálogo, comparte contenido que usted mismo ha capturado.
Si considera que algún contenido vulnera sus derechos, puede comunicárnoslo en info@smartco.es para su revisión.
6 Protección de datos
El tratamiento de sus datos personales se rige por la Política de Privacidad, accesible desde el sitio. Le recomendamos su lectura para conocer cómo tratamos sus datos y cómo puede ejercer sus derechos.
7 Un servicio gratuito
Adtropia es gratuito para el usuario. Su modelo de negocio puede incluir la elaboración y comercialización de información estadística agregada y anonimizada sobre tendencias e intereses, en los términos y con las garantías descritas en la Política de Privacidad. Esto no implica facilitar a terceros su cuenta, su catálogo individual, su identidad ni su historial individual de contenidos guardados.
Si en el futuro se introdujeran funciones de pago, se informaría con la debida antelación y no afectarían a las condiciones ya aceptadas sin su consentimiento cuando este resulte necesario.
8 Disponibilidad y responsabilidad
SmartCo pone medios razonables para mantener el servicio disponible y funcionando correctamente, pero no garantiza su disponibilidad ininterrumpida ni la ausencia de errores. El servicio se presta «tal cual».
En la medida permitida por la ley, SmartCo no será responsable de los daños derivados de interrupciones, fallos técnicos o del uso que usted haga del servicio. Nada en estas Condiciones excluye o limita la responsabilidad que no pueda excluirse o limitarse conforme a la normativa aplicable, en particular la de protección de los consumidores.
9 Propiedad intelectual de Adtropia
La marca Adtropia, el software, el diseño y los contenidos propios del servicio pertenecen a SmartCo o a terceros que han autorizado su uso, y están protegidos por la normativa de propiedad intelectual e industrial. Estas Condiciones no le transfieren ningún derecho sobre ellos más allá del uso del servicio conforme a lo aquí previsto.
10 Modificación de estas condiciones
Podemos actualizar estas Condiciones para reflejar cambios en el servicio o en la normativa. Le informaremos de los cambios significativos a través de la aplicación o del sitio. La fecha de la última actualización figura al inicio de este documento.
11 Duración y baja
Puede dejar de utilizar Adtropia en cualquier momento. Puede eliminar su cuenta desde los ajustes de la aplicación; la eliminación es efectiva y conlleva el borrado de sus datos personales en los términos descritos en la Política de Privacidad.
SmartCo podrá suspender o cancelar su cuenta en los supuestos previstos en la sección 4.
12 Ley aplicable y jurisdicción
Estas Condiciones se rigen por la legislación española. Para la resolución de cualquier controversia, las partes se someten a los Juzgados y Tribunales de Madrid, sin perjuicio del fuero que legalmente corresponda al usuario cuando actúe como consumidor.
En caso de discrepancia entre las versiones en español e inglés de estas Condiciones, prevalecerá la versión en español.
Terms of Service
1 Purpose and acceptance
These Terms of Service (hereinafter, “the Terms”) govern the relationship between SmartCo Iniciativas Tecnológicas, S.L. (“SmartCo”) and the persons who use the Adtropia application and service (“Adtropia” or “the service”). By registering for and using Adtropia, you accept these Terms; if you do not agree with them, do not use the service.
These Terms are complemented by the site's Legal Notice and Privacy Policy, which form part of the framework for using Adtropia.
2 Access and minimum age
To create an account and use Adtropia you must be over 18 years of age. Adtropia is a service aimed at adults and is not intended for minors.
Access is via authentication with an external provider (Google or Apple). You are responsible for the accuracy of the details you use to sign in.
3 Your account
Each account is personal. You are responsible for the activity carried out from your account and for keeping confidential your access to the identity providers you use.
The catalogue of ads you create in Adtropia is associated with your account and is for personal use.
4 Acceptable use of the service
You undertake to use Adtropia lawfully and in accordance with these Terms. In particular, you undertake not to:
- Use the service for unlawful purposes or in a way that infringes the rights of third parties.
- Attempt to access accounts, data or areas of the service that do not belong to you.
- Interfere with the operation of the service, introduce malicious code or carry out automated data extraction.
- Impersonate other people or entities.
If we detect any use that may breach these Terms, we will notify you and ask you to correct it, telling you how to do so.
If the breach is serious or continues after our notice, SmartCo may suspend or terminate your account and deactivate the affected shared links, informing you of the reason. Where the use is unlawful or puts the service, other users or third parties at risk, we may take these measures without prior notice and inform you afterwards.
5 Your content and your catalogue
SmartCo does not claim ownership of the ads you capture and save (“your content”), nor of the tags and corrections you add.
To provide the service, you grant SmartCo a limited, non-exclusive and free licence to store, process and analyse your content to the extent necessary to build and maintain your personal catalogue and the associated features (such as automatic organisation using artificial intelligence), and to produce the aggregated and anonymised statistical information described in the Privacy Policy. This licence over content does not replace or alter the legal bases applicable to the processing of personal data, which are described in the Privacy Policy. The licence over your content ends when you delete that content or your account; statistics that have already been effectively anonymised may be retained under the terms set out in the Privacy Policy.
You are responsible for the content you capture. Ads may contain trademarks, images and creatives owned by their respective advertisers; Adtropia lets you organise, for your personal use, content you have already come across, and does not itself distribute third-party advertising creatives. When you share an ad from your catalogue, you share content you have captured yourself.

6 Data protection
The processing of your personal data is governed by the Privacy Policy, accessible from the site. We recommend reading it to understand how we process your data and how you can exercise your rights.
7 A free service
Adtropia is free for the user. Its business model may include producing and commercially offering aggregated and anonymised statistical information about trends and interests, under the terms and safeguards described in the Privacy Policy. This does not mean providing third parties with your account, your individual catalogue, your identity or your individual saved-content history.
If paid features were introduced in the future, we would give due notice and they would not affect previously accepted terms without your consent where such consent is required.
8 Availability and liability
SmartCo uses reasonable means to keep the service available and working correctly, but does not guarantee uninterrupted availability or the absence of errors. The service is provided “as is”.
To the extent permitted by law, SmartCo will not be liable for damages arising from interruptions, technical failures or your use of the service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, in particular consumer protection law.
9 Adtropia's intellectual property
The Adtropia trademark, the software, the design and the service's own content belong to SmartCo or to third parties who have authorised their use, and are protected by intellectual and industrial property regulations. These Terms do not transfer to you any rights over them beyond use of the service as provided herein.
10 Changes to these terms
We may update these Terms to reflect changes in the service or in the regulations. We will inform you of significant changes through the application or the site. The date of the last update appears at the beginning of this document.
11 Term and cancellation
You may stop using Adtropia at any time. You can delete your account from the application settings; deletion is effective and entails the erasure of your personal data as described in the Privacy Policy.
SmartCo may suspend or terminate your account in the cases set out in section 4.
12 Applicable law and jurisdiction
These Terms are governed by Spanish law. For the resolution of any dispute, the parties submit to the Courts and Tribunals of Madrid, without prejudice to the jurisdiction that legally corresponds to the user when acting as a consumer.
In the event of any discrepancy between the Spanish and English versions of these Terms, the Spanish version shall prevail.
